Employers with a comprehensive drug testing policy as part of their drug-free workplace program often include reasonable suspicion testing, also known as for-cause or probable-cause testing. Reasonable suspicion testing must be based on individualized suspicion of a particular employee, and employers need to document objective facts that would suggest to a reasonable person that the individual is under the influence in violation of company policy. On March 18, 2020, President Trump signed the Families First Coronavirus Response Act (“Act”) into law. There are two paid leave sections of the Act that private employers with fewer than 500 employees and public agencies must be aware of: (1) the Emergency Family and Medical Leave Expansion Act (the “EFMLEA”) and (2) the Emergency Paid Sick Leave Act (the “EPSLA”).
