Federal Court Invalidates Federal Overtime Rule
NOVEMBER 15, 2024 – The U.S. District Court for the Eastern District of Texas just issued its ruling
invalidating the entirety of DOL’s overtime final rule. In his ruling, Judge Jordan stated that while DOL has the authority to define and delimit the terms of the overtime exemption, “that authority ‘is not unbounded.’”

AUGUST 21, 2024 – Earlier in the year, Federal Trade Commission (FTC) issued a new rule which essentially bans non-compete limitations for workers in the United States. The rule banning non-competes is scheduled to take effect on September 4, 2024.

AUGUST 20, 2024 – OSHA has been working on a heat stress standard since President Biden took office in 2021. On July 2, it released a proposed rule on “Heat Injury and Illness Prevention in Outdoor and Indoor Work Settings”.

DOL Overtime Rule Update
AUGUST 9, 2024 – As of July 1, 2024, the U.S. Department of Labor (DOL) instituted a significant change affecting the Fair Labor Standards Act’s (FLSA) overtime rules (see attached alert on the issue). The new overtime rule increases the minimum salary threshold for employees to qualify for the white-collar exemption from overtime pay requirements.
DOL Issues New Rules Defining Overtime Exemptions
JULY 1, 2024 – On April 23, 2024, the U.S. Department of Labor (DOL) published a final rule that raises the minimum annual salary threshold to classify an employee as exempt from overtime rules under the Fair Labor Standards Act (FLSA).
